Especially Sensitive Workers


Article 25 of the Occupational Risk Prevention Law defines a particularly sensitive worker as one who, due to his or her personal characteristics or known biological condition, including those with a recognized physical, mental or sensory disability, is more vulnerable to the risks derived from his or her work.

Therefore, it can be said that particularly sensitive workers include the following groups:

  • Workers sensitive to certain risks (art. 25 LPRL).

  • Pregnant or breastfeeding women (art. 26 LPRL).

  • Minor workers, meaning those over 16 and under 18 years of age (art. 27 LPRL).

  • Workers with disabilities (art. 25 LPRL).

It implies the application of the principle of adaptation to work that combines the objective evaluation (risk assessment) with the subjective (personal capabilities), and implies the obligation of the Prevention Service, to mark protocols for the identification of special characteristics and / or implementation of adaptations of jobs for this type of situations.
